Planning Commission Meeting

Monday, December 2nd, 2024, 6:00 PM

Greenland Community Center

Members Present: Charlotte Carnes, Hunter Collins, Colbi Johnson, Brenda Reynolds, Dan Cypert, and Bill Yoes

Meeting called to order at 6:00 PM.

Motion to amend agenda to add Business License Application: Ozark Ready Mix Company, INC.

Cypert motioned to approve. Johnson seconded. Approved 5-0.

 

  1. Public Hearing: Best Choice Holdings LLC, W Napier Dr and NE Campbell Rd Preliminary Plat
    1. Blake Murray with Crafton Tull. 2.8 units per acre. 463 buildable lots, 4 unbuildable, one fire station, 4 phases, 163+/- site area. Previously approved as PZD. Fayetteville sewer service, Washington Water Service.
    2. Cypert stated there was some concern about whether this was a single builder development or multiple builders. One builder specifically concerned about was D.R. Horton. This was different than what was stated originally. His concern is that the city is borrowing West Fork’s building inspector. The City of Greenland needs to hire a building inspector to ensure quality control is assured.
    3. Nothing has changed from the original plans other than losing a few lots due to sewer issues.
    4. Closed Public Hearing 6:18 PM.

  1. Zoning Map Amendment: Martin Subdivision
    1. Parcels: 775-39164-000, 775-39165-000, 775-39166-000, 775-39167-000, 775-39168-000, 775-39169-000, 775-39170-000, 775-39171-000, 775-39172-000, 775-39173-000, 775-39174-000, 775-39175-000, 775-39176-000, 775-39177-000
    2. These parcels are in an established subdivision and the deed notes a covenant “residential use only”. When the property was annexed into the City of Greenland and zoning districts were created, the subdivision was inadvertently included in the C3 zoning. The recommendation is to zone the property R-3.
    3. Planning Commission is requesting Council to amend zoning for the Martin Subdivision parcels from C-3 to R-3.
    4. Collins motion to amend. Cypert second. Approved 5-0

 

  1. Business License Application: Ozark Ready Mix Company, Inc.
    1. 965 W. Napier Drive. Location of existing Shepard Construction. LSD for concrete business. Previously Planning denied the license due to use incompatibility with Code. Council approved the business license. Shepard Construction has not obtained a certificate of occupancy. Shepard Construction has not completed construction.
    2. The concrete company does not fit the intended use of the light industrial zoning. This use was approved previously only because of an ambiguous use chart. This use chart is no longer in the code. Being that this will be a new business, it must meet the current code. The light industrial use code has the intent of industrial businesses that are conducted indoors, without the issue of dust, sound, or heavy transit. This business will not meet the code. The roads to and from the property cannot handle the truck traffic. The building currently on the lot is out of compliance. It does not meet the design standards nor have there been any steps to make the building meet design standards in the past two years. The building was not specifically designed for concrete companies. It could be occupied by businesses which meet the light industrial use.
    3. Cory Mitchell – lives on SE Campbell. Shepard has not done what they were supposed to do. He is worried that the new company coming in will try to get the same conditional use permit that Shepard Construction operated under. The citizens were instructed that there is no CUP and the only reason that the company was allowed to conduct business was due to the overriding of Council over the Planning Commission recommendation.
