Planning Commission Meeting

Monday, October 6th, 2025 6:00 PM

Greenland Community Center

Members Present: Dan Cypert, Charlotte Carnes, Hunter Collins, Colbi Johnson, Brenda Reynolds, Bill Yoes

Meeting called to order at 6:04 PM.

  1. Public Hearing: Axis Electric Sign Permit Application
    • Mitch Harriman to present. 4.6’x6’ wide monument sign being presented for the business at 1062 N Campbell Road.
    • No planning commission discussion.
    • Johnson motioned to approve. Cypert seconded. Approved 5-0.
  2. Public Hearing: Cowan 911 & 913 W. Wilson St. Rezone
    • Anita Cowan to present. Applicant currently has rental properties on the three parcels (two addresses). The intent is to rezone to ensure development for commercial in the future. The properties are already surrounded by commercial zoning.
    • Collins motioned to recommend approval. Johnson seconded. PC recommended approval to Council 5-0.
    • An ordinance will need to be drawn for the rezone to be heard at upcoming Council meeting.
    • PC requests the rezone application is amended to add a space for parcel numbers.
  3. A-1 Zoning Follow up
    • PC has not heard any news about the zoning from the previous annexation which may need addressed. In November, the annexation is going on the ballot. The A-1 zoning needs to be developed so it is in place if annexation is passed. The ordinance for the A-1 zoning will have to be adopted before it can be applied to newly annexed parcels. This will allow certain parcels that are more in line with A-1 zoning to be adopted in the adopted annexation.
    • City Engineer to draft the A-1 zoning for PC review prior to next meeting. Review by the PC will be discussed at the November meeting.
  4. Public Comments
    • Michelle Cates – 10211 SW Campbell Road. The Cates family purchased 12 acres from the Reynold family a few years ago. The request is to split the parcel into two lots, roughly down the middle between the house and pond. Mrs. Cates was advised to submit the lot split application to be heard at the December Planning Commission meeting.
    • Brett Park – Parkco Architects – His client is wanting to tear down their existing horse barn and replace it with a new barn, within the setbacks, on higher ground. There will not be any net increase in impermeable area. This is a prime example of the A-1 zoning that is needed for the zoning code. The PC advises that the barn is a residence of horses. In that case, this parcel’s primary use is housing of horses. That will deem the barn as the primary structure since it is replacing a current, existing barn structure. The parcels around it constitute over 92 acres. The annexation of this property as C-3 is not the best use for this low-lying agricultural area in this instance. The PC recommends this is a permitted use for the property. Therefore, the applicant will apply for a building permit. The intent of the PC, if it is determined the prior annexation zoning needs addressed, will be that this area be classified A-1.
    • Eric Poquette with EPCO to present. The owner wants to replace his current business building, which was severely damaged by a tornado earlier in the year, with a 30’ x 80’ building. The railroad, located near the western property line, told Mr. Poquette there exists a 22’ easement in that location. The current side setback, located on the southern property line, is 15’ and the request would be to move 10’ inside that setback to yield a 5’ side setback to the southern property line. There is an autobody shop to the south of this property. The City Engineer explained that there will be a fire rating for that southern wall if this is granted. PC advised Mr. Poquette to apply for the variance with all applicable documentation and a survey so a better understanding of the easements and setbacks could be discussed.

 

Motion to adjourn by Yoes. Seconded by Johnson. Meeting adjourned 6:55 PM.
