Planning Commission Meeting

Meeting called to order at 6:00 PM.
1. Public Comments
Brenda Reynolds speaking as public citizen. Regarding the parcel to the south of
her residence, parcel #775-18034-000. She received a call about more clearing
being done, then spoke with the last contractor who cleared the land who claimed
they have “wiped themselves clean of the project” , “they did not have equipment
large enough to complete the project”, and “did not know who the new company
was that is doing the other work”. She called the City of Greenland and asked if
they have a SWPPP, but the city was not aware of if one existed but would check.
This is an issue, as a SWPPP is required to clear land over 1 acre and also in order
to receive a grading permit. The concern is that the code is not being followed if a
SWPPP or grading permit has not been obtained.
Ms. Johnson asked if we still have a code enforcement officer. Ms. Reynolds
confirmed that we do. There is an issue with the code enforcement across
Greenland. The council members and city attorney need to be notified.
T&K Shephard Construction has been sold to Eagle Concrete; a company which
is much larger in size. This business license never went through the planning
commission, per the Council’s directions as the procedure for reviewing business
licenses before issuance. Both, M&S Concrete & T&K Shephard, were denied by
the Planning Commission but the businesses were approved by the City Council
and licenses issued. The Code was not followed, but both businesses were
“grandfathered” based on the consent/approval. The Code was reworked to better
clarify the intended/permitted uses in the zones, and this was done prior to the
new Eagle Concrete company obtaining their business license. Two concrete
companies approached Planning about purchasing the business, but their use
was going to be larger and Planning advised it would not be permitted per the
Code terms. Planning was not involved in the approval given to Eagle Concrete.
T&K Shephard Construction did not have a permanent certificate of occupancy.
This increase in traffic is damaging the roads; runoff is unclean and large amounts
of waste is being tracked into the street and through the existing drainage system..
An email was sent by C. Johnson to code enforcement, Mayor and Chair; that
email and photos are attached.
Many citizens are upset about the most current annexation. The planning
commission was not aware of an annexation until citizens inquired, and planning
has not been involved. City’s web page wording says the land will be zoned
“Residential Agricultural.” We do not have a zoning with that designation.
Hunter Collins inquired about the paving that has been completed, and why
planning or engineering is not consulted during the process. There are areas
where the guttering protrudes up at an angle, will cause water runo into adjacent
yards, is not up to standard, and they were not fixed prior to the paving—the paving
just got put right over them. These issues need to be considered and reviewed by
the City Engineer beforehand to avoid problems like what exist now.
