Planning Commission Meeting Monday July 3, 2017 6:00 PM at City Hall

The Commission reserves the right to reprioritize its consideration of the items on the agenda.

Commissioners present: Brenda Reynolds, Bill Yoes, Charlotte Carnes, Lee Guthrie, Paula Schoonover; meeting started 6:00 p.m. Called meeting to order at 6:00 p.m.

    1. Liquor Sales:  proposed items for continued consideration

    Brenda gave us a draft alcohol sales ordinance. Discussed definitions. Primary business for bar and restaurant is food versus alcohol for permit.

    Took out 60/40 ratio of alcohol versus food for restaurants.

    On application for permit, they have to state a ratio of alcohol versus food and we can issue warnings, etc., if they don’t follow their application statements.

    Need to create an application form for filing for a permit by alcohol retailers.

    Permit fees: Recommend a permit fee for all: private clubs and new permits and renewed permits: $250/year.

    Distances for off-premise/on-premise to other establishments:

    Restrict alcohol sales (on premise or off) to C3 and allow our setback rules to apply (25’ front/side, 35’ rear). Get rid of property line to property line references. Change our use chart to include alcohol sales to show what zones permitted. Conditional use permit can be applied for in any other zones aside from C3.

    Restrictions for churches, parks, schools, daycare, abuse treatment center: 100 yards from edge of liquor establishment to property line of above-mentioned.

    RE: on-premise establishments with outdoor patio or entertainment area: last call at 11:00 p.m. Establishment closes at 12:00 p.m. Move band inside at 10:00.

    Brenda to check Fayetteville’s sound ordnance re: decibels allowed. Will be looking at revamping our noise ordinance.

    Supplemental tax per Arkansas Code Annotated, we recommend 10%.

    1. Zoning – continued discussion:

    On map used by Planning Commission to make recommendations for zoning changes in planning areas: #7 leave as is, no zoning change. Leave as C2 not change to C3. We are still good with our recommendations for planning areas, with that one change which is in the city limits (#7).

Next month Planning Commission meeting, address business license fees.

Commissioner Carnes motioned to read minutes; Commissioner Yoes 2nd. Pass 5-0

Commissioner Schoonover motioned to approve minutes as read; Commissioner Yoes seconded; Pass 5-0.

Commissioner Guthrie motioned to adjourn. Commissioner Carnes 2nd. Pass 5-0. Adjourned at 7:42.

Our former Mayor, Bill Groom passed away unexpectedly just a few weeks after leaving office. Bill had his heart set on spending more time with his wife and family members after twelve years as our Mayor, and two years spent on the city council.
