Monday, March 2, 2020

Commissioners present: Brenda Reynolds, Charlotte Carnes, Paula Schoonover, Hunter Collins, Bill Yoes, Michael Rutherford
Called meeting to order at 6:04 p.m.
- Public Hearing: Lot Split-corner of Hwy 71 and Westfork of White River. Tim with Atlas Surveying presented. Use is for proposed a house for property owner’s grandson. Plat was revised per City Engineer’s requirement to include easement. No public comment or discussion from Commission. Public hearing closed @ 6:07.
- Lot split-corner of Hwy of 71 and West Fork of white river. Motion to approve: Yoes, 2nd: Carnes, Passed 5-0.
- Business license 375 N. Main. Richard DeMent with DeMent Cylinder Service spoke. Cylinder repair service– all activity will be enclosed, no vehicles kept on property, parking lot is for customers coming in/out. Sign discussion: pole sign and building sign– two different signs and will require permits; pole sign will need to follow Landscape Code. Landscaping Code discussed- either he or landlord will need to follow Landscaping Code to bring current. No public comment. Motion to approve business license: Yoes, 2nd: Collins, passes 5-0. Application signed by Chair Reynolds for city staff to issue license.
Administrative Note: An application for a business license was presented last month. Planning Chair wants to clarify on record that she commented incorrectly that the fees were payable when the application was accepted. Business license applications do not incur a review fee, but only the fee for the actual license. All other applications require the “application fee” at the time it is submitted.
PUBLIC COMMENT: Citizen Adam Wallworth and Amanda Henry spoke regarding property they moved out of, and the now apparent inability to be able to resell house & property. Realtor Adam Steenken with Re/Max also spoke about the failed sale due to the potential inability to reubuild pursuant to the current Greenland Code. Discussion occurred; status discussed as to Council reviewing this issue again for their next meeting; additional discussion regarding Fayetteville’s Code allowing rebuilding within 18 months, rezoning, and/or allowing mixed use.
Paul Thompson of 563 Cato Springs Road Spoke about why this property should not be zoned as commercial. He states that the inability to have out buildings makes the land owners always having to come and get permission to build houses because of zoning.
After discussion, it is PC’s determination to recommend adding Fayetteville’s Code language to the previously-proposed Code revision PC has given to the Council. This is to provide a “cushion” or “temporary fix” for any city resident who are, or may be, facing a detrimental position regarding their property until a more definitive resolution can be obtained. Motion by Carnes to add Fayetteville Code 164.12 (A5) b (this was provided by Chair to Council, PC, City Attorney in email she sent everyone earlier this month). Motion made by Commissioner Collins, 2nd by Commissioner Carnes. Passed 5-0. Chief Gary Ricker: City will be seeking lot split on park property; will be on next month’s agenda.
Chair and Secretary will review Minutes and forward to PC.
